暂予监外执行制度的规范与重塑

暂予监外执行是我国特有的刑罚执行变更方式，其彰显了我国宽严相济的刑事政策和体现了我国行刑人道主义的精神。但由于我国暂予监外执行制度在立法设计上不完善、司法实践中执行混乱，导致出现了权钱交易、纸面服刑等恶劣问题。本文立足于暂予监外执行制度的现状，通过分析暂予监外执行制度中存在的立法和司法实践中的不足，提出了废除刑期折抵、明确单一决定主体、建立诉讼化程序和构建多元监督机制等立法构想，为重塑我国的暂予监外执行制度建言献策。
Suspension of imprisonment is a unique form of change in the execution of penalties in China, which demonstrates China’s criminal policy of leniency and severity and embodies the spirit of humanitarianism in the execution of penalties in China. However, due to the imperfect legislative design of the system of provisional release from prison in China, the implementation of the judicial practice is chaotic, resulting in the emergence of power and money transactions, paper sentences, and other bad problems. Based on the current situation of the provisional release system, this paper analyses the deficiencies in the legislation and judicial practice of the provisional release system, and puts forward legislative concepts such as abolishing sentence offset, clarifying the main body of a single decision, establishing a litigation procedure and constructing a pluralistic supervision mechanism, so as to provide advice and suggestions for the reconstruction of the provisional release system in China.
