人类社会已然进入互联网时代，信息网络技术的发展使音乐产业受到极为深刻的影响。在网络音乐产生的同时，大量的流媒体平台建立并发展起来。为规制网络音乐领域中“抢夺独家版权”“哄抬许可费”“恶性竞争”等乱象，必须提高对网络音乐版权许可问题的重视，在明确网络音乐与传统音乐区别的基础上，以利益平衡为基本原则，限制独家许可，加强法定许可的适用，发挥音乐著作权集体管理组织的作用，打破网络音乐版权垄断问题，稳定市场秩序，有效保护网络音乐著作权人的合法权益。

At the same time as the emergence of online music, a large number of streaming media platforms were established and developed. In order to regulate the chaos in the field of online music, such as “grabbing exclusive copyright”, “jacking up license fees” and “vicious competition”, we must pay more attention to the issue of online music copyright licensing. On the basis of clarifying the difference between online music and traditional music, we must take the balance of interests as the basic principle, restrict exclusive licenses, strengthen the application of statutory licenses, and give play to the role of collective management organizations of music copyright. Break the monopoly of Internet music copyright, stabilize the market order, and effectively protect the legitimate rights and interests of Internet music copyright owners.
