离婚冷静期制度的实践检视及完善分析

自《民法典》颁布实施开始，我国在法律层面正式确立了离婚冷静期制度，对于一项新制度而言，具体实践情况是十分值得关注的问题。经过三年的实施，婚姻相关数据有了一定的积累，对民政公报的数据进行统计和分析，可以从宏观层面对制度的实施效果进行检视，直观了解该制度的立法目的是否实现。此外，该制度具有很强的社会性，并且法的社会效果是衡量一项法律制度良善与否的一个重要维度，通过社会调研的方式，让民众直接参与到对“离婚冷静期”制度的讨论，能在一定程度上反映该制度的群众基础和社会效果。本文通过数据统计分析和社会调研的方式，对“离婚冷静期”制度的实践情况进行检视，发现该制度在“冷静期”期限、特殊情形权利保护、登记程序等方面尚且存在一些实践困境，同时也针对这些问题进行完善分析。
Since the promulgation and implementation of the Civil Code, China has officially established the divorce cooling-off period system at the legal level. For a new system, the specific practice is a very noteworthy issue. After three years of implementation, there has been a certain accumulation of marriage-related data, statistics and analysis of the data in the civil affairs bulletin can examine the implementation effect of the system from the macro level, and intuitively understand whether the legislative purpose of the system has been realized. In addition, the system has a strong sociality, and the social effect of law is an important dimension to measure whether a legal system is good or not. Through social research, the public can directly participate in the discussion of the “divorce cooling-off period” system, which can reflect the mass base and social effect of the system to a certain extent. Through statistical analysis of data and social research, this paper examines the practice of the “divorce cooling-off period” system, and finds that there are still some practical difficulties in the system in the “cooling-off period” period, protection of rights in special circumstances, registration procedures and other aspects, and also analyzes these problems.
