浅析直播平台与网络主播新型劳动关系的认定

Abstract:
通过分析网络主播的工作形式和特点,不难发现数字经济背景下新型劳动关系认定与传统劳动关系存在区别,实践中的案例也证明了合同名称不能决定合同性质,当二者不对应的情况下,应按本质予以认定。认定的准确与否直接影响对该新兴产业及劳动和的权益保护程度高低。鉴于当前数字经济的发展趋势,对于网络主播的劳动关系认定应适当明确及更新现有劳动关系认定的标准或者可以在实践中以案释法增加既有标准对新型问题上的理解与适用,实现法律层面上充分保护网络主播权益与新型灵活用工关系的可持续发展。
By analyzing the work form and characteristics of network anchors, it is not difficult to find that there are differences between the identification of new labor relations and traditional labor relations in the context of the digital economy, and the cases in practice also prove that the name of the contract cannot determine the nature of the contract, and when the two do not correspond to the case, it should be recognized according to the essence. The accuracy of the determination directly affects the degree of protection of the rights and interests of the new industry and labor. In view of the current development trend of digital economy, the labor relationship of webcasters should be clarified and updated appropriately, or the existing labor relationship standards can be increased in practice by case law interpretation, so as to increase the understanding and application of existing standards on new issues, realize the legal level to fully protect the rights and interests of network anchors and sustainable development of the new flexible labor relations.
