互联网时代我国网络法律建设面临的困境与对策研究
Research on the Dilemma and Countermeasures Facing the Construction of China’s Network Law in the Internet Era

互联网时代网络法律建设的迫切性与我国网络法律建设的滞后性的矛盾日益突出。当今，我国网络法律建设面临着立法滞后与不完善、司法困难、执法难度大、国际协调困难等显著困境。在深层把握互联网时代我国法律建设面临困境的原因后，本文提出破解我国网络法律建设困境的五条对策：加快立法进程、完善司法规则、加强执法力度、提高公众法治意识、推动国际合作与全球治理。
The contradiction between the urgency of cyberlaw construction in the Internet era and the lagging nature of cyberlaw construction in China is becoming increasingly prominent. Nowadays, China’s network law construction is faced with significant dilemmas such as lagging and imperfect legislation, judicial difficulties, difficulties in law enforcement, and difficulties in international coordination. After deeply grasping the reasons for the dilemma of China’s legal construction in the Internet era, this paper puts forward five countermeasures to crack the dilemma of China’s cyber law construction: accelerating the legislative process, improving judicial rules, strengthening law enforcement, raising public awareness of the rule of law, and promoting international cooperation and global governance.
