With the rapid development of the Internet, personal information security issues have become increasingly prominent. The phenomenon of personal information infringement is constantly emerging, causing great mental damage to victims. Therefore, this article will deeply analyze the theoretical basis of compensation for mental damage caused by personal information infringement, and explore it in detail with practical cases. Firstly, this article clarifies the connotation and legitimacy of compensation for mental damages caused by personal information infringement; Secondly, the problems faced when personal information rights are violated were discussed through case studies; Finally, corresponding improvement suggestions are proposed for the imperfect compensation system for mental damages caused by personal information infringement in China’s current legal system. To conclude, the research in this article aims to strengthen the theoretical and practical development of personal information protection and safeguard the legitimate rights and interests of information subjects.
