Abstract:

为充分发挥约谈制度的作用,切实提升反垄断执法效能,市场监督管理总局出台《滥用行政权力排除、限制竞争执法约谈工作指引》。该指引的出台顺应了反垄断执法刚柔并济的制度构建需要,既是创新传统规制谱系的题中之意,也是兼顾节约行政资源与提高治理效率的内在要求。该指引立足约谈工作的常见问题与基本要求,有效回应了约谈程序设置、约谈效果跟踪等社会关切,具有明确界定约谈工作的意涵与范畴、规范构建约谈工作全链条程序控制机制、灵活提供多元主体智库支持以及合理配置递进式监管手段等内容亮点。在具体落实过程中,要着重彰显约谈工作的合作性,进一步优化约谈工作公开化管理体系,同时还要深入扩充约谈跟踪评估维度,为约谈工作的顺利开展提供有力指引。
In order to give full play to the role of the interview system and effectively improve the efficiency of anti-monopoly law enforcement, the State Administration for Market Regulation issued the Guidelines for Abuse of Administrative Power to Eliminate or Restrict Competition Law Enforcement Interviews. The promulgation of the Guidelines conforms to the need to build a system that combines rigidity and flexibility in anti-monopoly law enforcement, which is not only the meaning of innovating the traditional regulatory spectrum, but also the intrinsic requirement of saving administrative resources and improving governance efficiency. Based on the common problems and basic requirements of the interview work, the guidelines effectively respond to social concerns such as the setting of the interview procedure and the tracking of the interview effect, and have the highlights of clearly defining the meaning and scope of the interview work, standardizing the construction of the whole chain of the interview work procedure control mechanism, flexibly providing multi-subject think tank support, and rationally allocating progressive supervision methods. In the process of specific implementation, it is necessary to highlight the cooperative nature of the work of the interviews, further optimize the open management system of the work of the interviews, and at the same time further expand the dimensions of the follow-up and evaluation of the interviews, so as to provide strong guidance for the smooth development of the work of the interviews.
