人工智能对知识产权法律保护的挑战及对策
Challenges and Countermeasures of Artificial Intelligence to Legal Protection of Intellectual Property Rights

人工智能飞速发展对知识产权法律保护带来前所未有的机遇与挑战。AI生成内容的权属认定、侵权责任界定等问题凸显，现有知识产权制度在应对AI挑战时还存在诸多不足和空白。本文在分析人工智能对知识产权法律保护挑战的基础上，提出健全相关法律制度、平衡创新与保护、加强执法、建立综合治理、加大宣传教育等五点对策建议，以期为完善人工智能知识产权法律保护、促进AI健康有序发展提供参考。
The rapid development of artificial intelligence has brought unprecedented opportunities and challenges to the legal protection of intellectual property. Problems such as the identification of ownership of AI-generated content and the definition of infringement liability are prominent, and the existing intellectual property system still has many shortcomings and gaps in responding to the challenges of AI. Based on the analysis of the challenges posed by artificial intelligence to the legal protection of intellectual property, this paper proposes five countermeasures and suggestions, including improving the relevant legal system, balancing innovation and protection, strengthening law enforcement, establishing comprehensive management, and increasing publicity and education, in order to provide references for improving the legal protection of artificial intelligence intellectual property and promoting the healthy and orderly development of AI.
