论区块链技术对证据法教学的实践性改革

Abstract:

法学教育面临信息技术的冲击,对法学教育从业者而言提出了新的挑战。区块链存证技术夯实了电子数据时代的真实性审查理论,并在司法实践中获得多维度的认可。但证据法教育却未能及时回应此技术发展的时代特征。证据法课程承担从理论到实践的桥梁作用,因此讨论区块链存证技术为证据法教育带来的创新作用将具备必要性。教导法学生认识区块链存证技术并学会如何使用,可使教育部提倡的OBE理念在证据法课堂上得到落实,同时也起到厘清应用型高校的法学课程教学改革方向的作用。应用方向改革涵盖倡导教师对区块链技术的学习、教学资源共享、司法案例实证研究以及随堂展示等不同具体实施方向。
Legal education is facing the impact of information technology, which poses new challenges for practitioners in legal education. The blockchain certification technology has solidified the theory of authenticity review in the era of electronic data and has gained multidimensional recognition in judicial practice. However, evidence-based education failed to respond promptly to the characteristics of this technological development era. The Evidence Law course serves as a bridge from theory to practice, therefore it will be necessary to discuss the innovative role of blockchain evidence technology in evidence law education. Teaching law students to understand blockchain evidence technology and learn how to use it can enable the OBE concept advocated by the Ministry of Education to be implemented in evidence law classrooms, and also play a role in clarifying the direction of law course teaching reform in applied universities. The reform of application direction covers different specific implementation directions, such as advocating for teachers to learn blockchain technology, sharing teaching resources, conducting empirical research on judicial cases, and on-site demonstrations.
