所有权保留买卖制度完善及其保障研究
Research on the Perfection of Ownership Retention Trading System and Its Guarantee

所有权保留买卖合同作为一种灵活且高效的交易方式，其应用范围已广泛渗透至现代经济活动的各个领域，其独特的交易模式极大促进了市场贸易的发展。然而随着市场经济的不断深化和复杂化，所有权保留买卖在实践中所蕴含的问题，尤其是买受人的期待权保护问题逐渐浮出水面并受到学界的密切关注。为减少纠纷的发生或者在纠纷发生时更好地保护当事人的合法权益，本文分析了当前所有权保留买卖存在的潜在风险并提出一些解决思路。
As a flexible and efficient transaction method, the application of ownership retention contract has been widely penetrated into every field of modern economic activities, and its unique transaction mode has greatly promoted the development of market trade. However, with the deepening and complexity of the market economy, the problems in the practice of ownership retention trading, especially the protection of the buyer’s expectation right, have gradually surfaced and been paid close attention by the academic community. In order to reduce the occurrence of disputes or to better protect the legitimate rights and interests of the parties when disputes occur, this paper analyzes the potential risks existing in the current ownership retention transaction and puts forward some solutions.
