数字法治政府建设中的个人信息保护研究

目前我国的数字政府建设如火如荼，政府的数字化转型也卓有成效，但这对我国的个人信息保护带来了新的挑战。首先，数字化背景下政府信息处理主体混杂；其次，大数据处理侵害个人信息处理告知同意制度；再次，电子政务公开与个人信息保护存在矛盾。以上种种问题都显示了，在我国数字法治政府建设中，个人信息保护是不容忽视的议题。为了在数字法治政府建设中更好地保障个人信息安全，需要进一步构建能与数字化相匹配的个人信息保护制度，严格规范政府信息处理主体，细化个人信息处理告知同意制度，并找到个人信息保护和政府信息公开的平衡点，进一步提高我国数字政府建设的法治化水平。
At present, our country’s digital government construction is in full swing, and the digital transformation of the government is also fruitful, but this brings new challenges to the protection of personal information in our country. Firstly, the government information processing subject is mixed under the digital background; second, big data processing infringes on the consent system of personal information processing; thirdly, there is a contradiction between the disclosure of e-government and the protection of personal information. All these problems show that the protection of personal information is an issue that cannot be ignored in the construction of digital rule of law government in our country. In order to better ensure the security of personal information in the construction of a digital government under the rule of law, it is necessary to further build a personal information protection system that can match the digitalization, strictly regulate the government information processing subjects, refine the personal information processing consent system, and find the balance point between personal information protection and government information disclosure, so as to further improve the rule of law level of China’s digital government construction.
