举报人作为行政诉讼原告资格的认定探析

Abstract:
在社会主义法治的进程中,人民群众的法律意识和维权意识日益提高,举报这一现象在生活实践中频繁出现,与“举报”相关的词语在司法文书中也屡见不鲜。本文首先从与举报有关的行政法的基本理论角度分析举报人的原告资格,此后通过对举报人作为原告诉讼资格所涉及的行政答复性质及利害关系判断两个方面的认定因素进行分析,研究现阶段其在理论与实务所面对的诉讼障碍、缺乏举报人的统一分类及实践困境三个问题,最终结合上述问题提出相应完善措施。
In the process of the Chinese-style modernization of the rule of law, the people’s awareness of law and rights protection is increasing day by day, and the phenomenon of reporting has frequently appeared in daily life practice, and the words related to “reporting” are also common in judicial documents. This paper first analyzes the plaintiff qualification of the whistleblower from the basic theory of administrative law related to reporting, and then analyzes the identification factors of the nature of the administrative reply and the judgment of the interest of the whistleblower as the plaintiff’s litigation qualification, so as to study the litigation obstacles it faces in theory and practice at this stage, the lack of unified classification of whistleblowers and the practical dilemma. Finally put forward the corresponding improvement measures according to the above problems.
