虐待动物行为的行政法律规制研究

本研究从探讨了虐待动物行为的法律规制必要性出发，并从立法目的、内容范围等不同角度梳理分析了我国现行法律体系中动物保护的相关规定。同时本文还提出了反虐待动物法律问题的现状，例如系统性法律缺失，缺乏明确认定标准以及流浪伴侣型动物管理薄弱等，并提供了完善行政法规，明确界定虐待动物行为等相对应的完善建议，以期为我国动物保护法律体系的完善提供参考，建议通过行政法律手段加强规制。
This study was introduced from the Internet blogger cat abuse news event, discussed the necessity of the legal regulation of animal abuse behavior, and analyzed the relevant provisions of animal protection in our current legal system from different angles such as legislative purpose and content scope. At the same time, this paper also puts forward the current situation of anti-animal abuse legal issues, such as the lack of systematic laws, the lack of clear identification standards and the weak management of stray companion animals, and provides corresponding improvement suggestions for improving administrative regulations and clearly defining animal abuse behaviors, so as to provide references for the improvement of China’s animal protection legal system. It is suggested to strengthen the regulation through administrative legal means.
