影视解说类短视频侵权的著作权法律问题研究

在互联网飞速发展时代下，以内容高度凝聚、时长简短、强娱乐互动性等为特征的新兴短视频逐渐成为广大群众业余生活的重要娱乐内容，随着网络剪辑愈加便捷化，影视作品解说类的二次创作作品大量涌现。由于二次创作用户获得著作权许可难度较大，在先作品著作权人、短视频平台与二次创作短视频用户之间存在一定利益冲突。本论文在我国的现行法律体系的基础上，以分析影视剪辑类短视频侵权问题为基础，总结了目前影视解说类短视频领域的著作权侵权问题法律根源，试图从合理使用、独创性、侵权责任认定等方面剖析并提出解决对策。
In the era of rapid development of the Internet, emerging short videos with high content concentration, short duration, and strong entertainment interactive features have gradually become an important entertainment content in the leisure life of the general public. With the increasing convenience of network editing, a large number of video works interpretation-type secondary creative works have emerged. Due to the difficulty of obtaining copyright permission for secondary creators, there is a certain interest conflict between the copyright holders of the original works, short video platforms, and secondary creators of short videos. Based on the analysis of copyright infringement problems in video editing short videos, this paper summarizes the legal roots of copyright infringement problems in the field of video interpretation short videos in China’s current legal system and tries to analyze and propose solutions from the perspectives of fair use, originality, and liability for infringement.
