本文旨在探讨我国非物质文化遗产的知识产权保护问题，分析现行法律体系尚存在的不足，并提出相应的完善建议。通过梳理非遗的概念、特征及其在知识产权保护中的特殊性，研究现行《非物质文化遗产法》《著作权法》《专利法》和《商标法》等法律在保护非遗方面的适用性和局限性，进一步提出完善我国非遗知识产权保护的具体对策。旨在推动我国非遗保护的法律实践，助力这些珍贵的文化遗产能够得到持续有效的保护和传承。
This article aims to explore the issue of intellectual property protection for intangible cultural heritage in China, analyze the shortcomings of the current legal system, and propose corresponding improvement suggestions. By sorting out the concept, characteristics, and particularity of intangible cultural heritage in intellectual property protection, this paper studies the applicability and limitations of current laws such as the Intangible Cultural Heritage Law, Copyright Law, Patent Law, and Trademark Law in protecting intangible cultural heritage, and further proposes specific measures to improve the intellectual property protection of intangible cultural heritage in China. Intended to promote legal practice in the protection of intangible cultural heritage in China, and to assist in the sustained and effective protection and inheritance of these precious cultural heritage.
