网约车个人信息保护存在的问题及路径研究

在当今信息时代，随着互联网的发展，网约车作为一种新兴产业出现在人们的生活中，在很大程度上解决了人们的出行问题。但是网约车在为我们提供便捷服务的同时，也存在着侵犯我们权利的问题，譬如乘客对“同意”条款是否知悉了解，行程中的录音录像是否存储、被谁存储、以及存储多久，乘客的个人信息(平台账号、位置、姓名、电话号码、目的地等)是否被泄漏，当个人信息泄漏时该如何救济等诸多问题。传统的监管办法已经不能满足现行的网约车模式，有必要从立法、政府有关部门、网约车平台、司机、乘客以及救济等层面来应对网约车个人信息带来的问题及风险。
In today’s information age, with the development of the Internet, online car rental, as a new industry, appears in people’s lives, which largely solves people’s travel problems. However, while providing us with convenient services, there are also problems that infringe on our rights, such as whether the passengers know the “consent” clause, whether the audio and video recordings during the trip are stored, by whom and for how long, whether the passengers’ personal information (platform account number, location, name, telephone number, destination, etc.) is leaked, and how to remedy when personal information is leaked. Traditional supervision methods can no longer meet the current online car rental model. It is necessary to deal with the problems and risks brought by personal information of online car rental from the aspects of legislation, relevant government departments, online car rental platform, drivers, passengers and relief.
