商标商品平行进口中的商标合理使用问题研究
Research on the Fair Use of Trademarks in the Parallel Import of Trademark Goods

随着全球经济的自由化发展和电子商务的迅猛崛起，商品平行进口的现象变得日益普遍。然而，针对商标平行进口的领域，我国尚缺乏明确具体的法律条款进行规范，这种法律空白已经引发了一系列问题和争议。本文介绍了平行进口中商标合理使用制度，并结合立法和司法实践分析了商标平行进口面临的困境，最后针对其中的问题提出了建议，即推进商标商品平行进口相关立法事宜、明确商标合理使用制度规定和统一商标合理使用认定标准。
With the liberalization of the global economy and the rapid rise of e-commerce, the phenomenon of parallel import of goods has become increasingly common. However, there is still a lack of clear and specific legal provisions to regulate the field of parallel import of trademarks in China, and this legal gap has caused a series of problems and controversies. This article briefly introduces the fair use system of trademarks in parallel imports, analyzes the difficulties faced by parallel import of trademarks in light of the current legislative status and judicial practice, and finally puts forward suggestions for the problems, namely, promoting the legislative matters related to the parallel import of trademarked goods, clarifying the provisions of the fair use system for trademarks, and unifying the criteria for determining fair use of trademarks.
