网络平台私权力扩张背景下行政主体理论的完善
The Improvement of Administrative Subject Theory under the Background of Private Power Expansion on Internet Platforms

平台私权力作为一种全新的社会行政权力形态，对建构在国家行政权力基础上的传统行政主体理论构成了冲击。面对平台私权力扩张给传统理论带来的挑战，国内行政法学者提出了若干应对方案，目前成型的观点有新型主体学说和社会行政主体理论，但诸多调试在与诉讼实践衔接层面都存在一定的张力。赋予网络平台“准行政主体”资格可以有效回应平台公司承负的规制主体义务；准行政主体作为履行公共职能的社会行政组织，应能独立承担公法上的责任。
As a new form of social administrative power, platform private power has challenged the traditional administrative subject theory constructed on the basis of national administrative power. Faced with the challenges brought by the expansion of private power on platforms to traditional theories, domestic administrative law scholars have proposed several solutions. Currently, there are emerging views such as the new subject theory and the social administrative subject theory, but many adjustments still have certain tension in connecting with litigation practice. Granting the qualification of “quasi administrative subject” to online platforms can effectively respond to the regulatory obligations undertaken by platform companies; as a social administrative organization that performs public functions, quasi administrative entities should be able to independently assume responsibilities under public law.
