大数据时代个人信息保护的刑法完善路径研究
Research on the Path of Perfecting the Criminal Law of Personal Information Protection in the Era of Big Data

在大数据时代，个人信息保护的刑法完善对于保障个人隐私权与尊严、促进技术与法律的和谐发展以及增强公众信任与社会稳定具有重要意义。然而，当前我国个人信息刑法保护存在界定不明确、行为方式界限模糊、罪名及罪数认定困难、刑罚及救济途径不足和知情同意原则适用不力等问题。本研究提出通过明确个人信息的法律定义与范围、完善行为方式与犯罪类型立法规定、规范罪名与罪数认定的司法实践、提升刑罚力度与救济机制有效性以及建立知情同意原则的法律实施框架等路径来完善个人信息的刑法保护。
In the era of big data, the perfection of criminal law for personal information protection is of great significance for guaranteeing individual privacy and dignity, promoting the harmonious development of technology and law, and enhancing public trust and social stability. However, at present, there are some problems in the protection of personal information in criminal law, such as unclear definition, vague boundary of behavior mode, difficulty in identifying charges and number of crimes, insufficient ways of punishment and relief, and ineffective application of the principle of informed consent. This study proposes to improve the protection of personal information in criminal law by clarifying the legal definition and scope of personal information, improving the legislative provisions on behavior patterns and crime types, standardizing the judicial practice of identifying charges and number of crimes, enhancing the intensity of punishment and the effectiveness of the relief mechanism, and establishing the legal implementation framework of the principle of informed consent.
