在大数据时代的背景下，因回应中国人民对个人信息保护的迫切需求，我国2021年1月1日起施行的《民法典》已明确将个人信息保护以法律形式进行明文规定；除此以外，《个人信息保护法》作为我国首部关乎个人信息保护的单行法规的颁布应运而生，自此，我国个人信息的法律保护进入全新时代。法律的出台虽然在一定程度上回应了现实的需求，但并未终结有关个人信息保护的争论。如何在个人信息保护与合理使用之间维持平衡，仍有深入研究的必要。
In the context of the era of big data, in response to the urgent need for personal information protection in China, the “Civil Code” implemented on January 1, 2021 has clearly stipulated the protection of personal information in legal form; in addition, the Personal Information Protection Law, as the first single law concerning the protection of personal information in China, came into being, and since then, the legal protection of personal information in China has entered a new era. Although the introduction of the law has responded to the practical needs to a certain extent, it has not ended the debate about the protection of personal information. How to maintain a balance between the protection of personal information and reasonable use, there is still a need for in-depth research.
