我国海洋生物多样性保护的法律探寻与展望
Legal Exploration and Prospect of Marine Biodiversity Protection in China

随着全球海洋资源利用加深，海洋生物多样性面临严峻挑战。作为海洋大国，我国保护海洋生物多样性至关重要。本文首先概述了国内外两个层面对海洋生物多样性保护的法律保障依据，然后，深入分析了我国海洋生物多样性保护面临的法律挑战，如尚未出台专门的海洋生物多样性保护法，执法力度有待提升以及公众在法律制定与实施中的参与度有限。为应对这些挑战，建议制定专门的海洋生物多样性保护法，加大执法力度，提高公众参与度，并加强国际合作，共同应对全球海洋生物多样性保护的挑战。
With the deepening of global Marine resource utilization, Marine biodiversity is facing serious challenges. As a large maritime country, it is vital for China to protect Marine biodiversity. This paper first summarizes the legal basis for Marine biodiversity protection at both domestic and foreign levels, and then analyzes the legal challenges facing Marine biodiversity protection in China, such as the lack of a special Marine biodiversity protection law, the need to improve the enforcement of law, and the limited participation of the public in the formulation and implementation of the law. To address these challenges, it is recommended to formulate a special Marine biodiversity protection law, strengthen law enforcement, increase public participation, and strengthen international cooperation to jointly address the challenges of global Marine biodiversity protection.
