以检察公益诉讼功能定位分析未成年人吸烟问题诉源治理路径
Positioning the Public Interest Litigation Function of the Procuratorate Analyzing the Source Governance Path of the Problem of Underage Smoking

本文围绕固镇县人民检察院对未成年人吸烟问题的诉源治理路径进行了深入分析。文章首先强调了检察公益诉讼在解决未成年人吸烟问题上的重要性，接着通过调研数据分析未成年人吸烟的现状、原因及存在的问题。文中指出，家庭、学校、社会、政府及法律监督在未成年人控烟方面均存在不足，特别是家庭教育的意愿和能力、学校监管的难度、社会环境的挑战及网络销售的监管难题等。为此，文章提出了推进未成年人吸烟问题诉源治理的具体路径，包括优化检察公益诉讼监督职能、提升综合保护能力以及加强宣传教育等，旨在形成多方合力，共同为未成年人创造一个无烟环境。
This paper makes an in-depth analysis of the path of the people’s procuratorate of Guzhen County to deal with the problem of underage smoking. Firstly, this paper emphasizes the importance of procuratorial public interest litigation in solving the problem of juvenile smoking, and then analyzes the present situation, causes and existing problems of juvenile smoking through investigation data. The paper points out that there are some deficiencies in family, school, society, government and legal supervision in tobacco control for minors, especially the willingness and ability of family education, the difficulty of school supervision, the challenge of social environment and the supervision problems of online sales. To this end, the article puts forward specific paths to promote the treatment of minors’ smoking problems, including optimizing the supervision function of procuratorial public interest litigation, improving comprehensive protection ability and strengthening publicity and education, aiming at forming a multi-party joint force to jointly create a smoke-free environment for minors.
