涉外离婚不动产分割的法律适用研究

在《涉外民事关系法律适用法》中，与涉外离婚不动产分割有关的法条包括第24条和第36条。但法院对这两个法条的适用并没有统一的规定，进而导致在涉外离婚不动产分割的案件中，有的法院直接适用第24条，有的法院同时适用第24条和第36条，还有的法院只适用第36条，司法实践很不统一。本文将研究的重点放在涉外离婚不动产分割上，从法律适用的层面探讨涉外离婚不动产分割的具体法律适用，得出在司法实践中应当适用第36条的结论，同时对于存在缺陷的第24条提出具体可靠的立法建议。
In the Law on the Application of Law in Foreign Civil Relations, the legal provisions related to the division of immovable property in foreign-related divorce include Article 24 and Article 36. However, there is no unified regulation on the application of these two articles by the court, which leads to some courts directly applying Article 24, some courts simultaneously applying Article 24 and Article 36, and some courts only applying Article 36 in cases of foreign-related divorce real estate division, resulting in inconsistent judicial practice. This article will focus on the division of immovable property in foreign-related divorce, exploring the specific legal application of the division from the perspective of legal application, and then concluding that the application of Article 36 is more reasonable in the legal application of the division of immovable property in foreign-related divorce.
