网络空间治理探究——兼评“杭州取快递被造谣案”

信息科技的快速发展，使得网络环境日趋复杂，网络空间治理难度也逐渐升高，各种网络平台上信息鱼龙混杂，低违法成本使得以网络诽谤为代表的网络侵权现象时有发生，网络空间经常陷入“失序”当中，同时取证和维权的困难以及相关法律规定的缺位使得该现象长期未得到有效解决，因此，有必要补充完善相关法律规定及其配套程序，同时注意发挥道德的教化作用，促进全体社会成员提升其法治意识并自觉守法，从而建立并维护一个健康有序的网络空间，促进社会和谐发展。
The rapid development of information technology has made the network environment increasingly complex, and the difficulty of managing cyberspace has also gradually increased. Various online platforms have mixed information, and low illegal costs have led to frequent occurrences of online infringement, represented by online defamation. The cyberspace often falls into “disorder”, and the difficulties of obtaining evidence and protecting rights, as well as the absence of relevant legal provisions, have caused this phenomenon to not be effectively resolved for a long time. Therefore, It is necessary to supplement and improve relevant legal provisions and supporting procedures, while paying attention to the role of moral education, promoting all members of society to enhance their awareness of the rule of law and consciously abide by the law, in order to establish and maintain a healthy and orderly cyberspace, and promote harmonious social development.
