地方“小切口”立法问题与完善

自2015年设区的市获得立法权限，地方性法规的数量与日俱增，在实践过程中呈现出数量多、法规形式不同以及内容相似的特点。“小切口”立法以其注重回应问题、切口小、内容实和结构精的特征越来越契合社会的发展变革。但是其在发展过程中暴露出选题过小、过于注重形式、内容趋同以及规避上位法的问题。完善地方小切口立法应该转变立法观念，坚持审慎立法原则；注重立法过程，健全选题论证；提高立法能力，加强法制队伍建设；推进区域协同立法，使必要的重复立法转变为区域一体化立法。
Since the cities divided into districts have obtained legislative authority in 2015, the number of local regulations is increasing day by day, which shows the characteristics of large number, different forms of regulations and similar content in the practice process. “Small incision” legislation is more and more in line with the development of society with its characteristics of focusing on responding to problems, small incision, solid content and fine structure. However, in the course of its development, it has been exposed that the topic selection is too small; too much attention is paid to the form, the content convergence, and the problem of avoiding the upper position method. To perfect local small incision legislation, we should change the idea of legislation and adhere to the principle of prudent legislation, pay attention to the legislative process, perfect topic selection argumentation; Improve the legislative ability and strengthen the construction of legal team. We will promote coordinated regional legislation and transform necessary duplicate legislation into regional integration legislation.
