论冷冻胚胎的法律属性
On the Legal Attribute of Frozen Embryo

冷冻胚胎作为具有人身意义的特定物，不仅具有权利人的人格利益，还具有物的属性，那么将冷冻胚胎的法律属性界定为人还是物，我国现行法律并未对其进行明确规定，因此，冷冻胚胎法律属性如何成为问题。三种主流学说，如权利主体说、一般财产说、特殊物体说从不同的视角对冷冻胚胎的法律属性予以分析论证，分别将冷冻胚胎界定为自然人、财物、伦理特殊物，但是由于各个学说理论无法自圆其说，存在缺憾。对此，可以在类型化的视角下，以当事人主观意志、胚胎社会性可能为基础，对冷冻胚胎的法律属性加以区分，予以区别对待。
Frozen embryo, as a specific object with personal significance, has not only the personality interests of the owner, but also the property of the thing. So the legal property of frozen embryo is defined as person or thing. Three main theories, such as the theory of subject of rights, the theory of general property and the theory of special object, analyze and demonstrate the legal attribute of frozen embryos from different perspectives. Therefore, the legal attribute of frozen embryos can be distinguished and treated differently in the perspective of typology, based on the subjective will of the parties and the possibility of embryo sociality.
