政府构建数字友好型社会研究——以英国《在线安全法案》为视角
How Can Governments Build a Digitally Friendly Society—Inspiration and Reference from British Online Safety Bill

[研究目的]英国《在线安全法案》是政府构建数字友好型社会的重要尝试，其褒贬不一，蕴含政府构建数字友好型社会的经验与尝试。[研究方法]通过分析其立法目的和规制理念，介绍其特殊内容，并结合该法案的积极评价和消极评价，以辩证看待该法案的得失。[研究结论]我国应当结合《在线安全法案》的积极效果，借鉴其对“合法但有害”信息的监管方式，形成政府主导的多元管理模式。同时应当警惕监管对言论自由的过度侵犯，寻找言论自由与网络监管的平衡。
[Purpose] The UK Online Safety Bill is an important attempt by the government to build a digital-friendly society. Its reviews and criticisms are mixed, which contains the experience and attempts of the government to build a digital-friendly society. [Method] Through the analysis of its legislative purpose and regulation concept, introduce its special content, and combine the positive and negative evaluation of the bill, in order to dialectically view the gains and losses of the bill. [Conclusion] Combining with the positive effects of Online Safety Bill, our country should draw lessons from its supervision methods of “legal but harmful” information to form a government-led pluralistic management model. At the same time, we should be alert to the excessive infringement of freedom of speech by regulation and find a balance between freedom of speech and network regulation.
