《民法典》视域下我国夫妻共同财产范围及其司法适用研究
Research on the Scope of Marital Joint Property and Its Judicial Application in China under the Perspective of the Civil Code

家庭是社会基本单元，通过法律规定明确夫妻共同财产范围对于维持婚姻稳定、家庭和谐、社会公平有着重要意义。本文针对《民法典》视域下的夫妻共同财产范围界定进行分析，发现《民法典》中针对婚姻家庭中夫妻共同财产范围的界定中仍然有较多笼统之处，不够清晰、具体、规范，在一定程度上导致司法实践中出现差异和争议。同时，《民法典》视域下夫妻共同财产制与物权法律存在一定的矛盾，共同财产制中法定财产制、约定财产制界限模糊，都在一定程度上影响夫妻共同财产范围界定，并影响其在司法实践中的适用情况，需要进一步完善夫妻共同财产制及其配套法律体系，以更好地维护双方财产权。
Family is the basic unit of society. It is of great significance to define the scope of common property of husband and wife through legal provisions for maintaining marriage stability, family harmony and social justice. This paper analyzes the definition of the scope of joint property between husband and wife under the perspective of the Civil Code, and finds that there are still many general points in the definition of the scope of joint property between husband and wife in marriage and family, which is not clear, specific and standardized, leading to differences and disputes in judicial practice to a certain extent. At the same time, there is a certain contradiction between the conjugal joint property system and the real right law under the perspective of the Civil Code. The blurred boundary between the legal property system and the agreed property system in the conjugal joint property system affects the definition of the scope of conjugal joint property to a certain extent and its application in judicial practice. Therefore, it is necessary to further improve the conjugal joint property system and its supporting legal system to better safeguard the property rights of both parties.
