刑法视野下敏感个人信息的特殊保护研究

Abstract:
大数据背景下，敏感个人信息的保护问题受到公众的广泛关注，仅仅依靠现有的《个人信息保护法》和刑法保护体系难以适应现实的需要。由于此类信息所具备的特殊性，倘若受到不法侵犯，自然会导致信息主体受到更加严重的多方面损害，亟需刑法规范给予此类敏感个人信息以特别保护，同时有助于合理衔接《个人信息保护法》等规定。因此，可以通过明确敏感个人信息的概念、取消敏感个人信息的分级以及提高侵犯敏感个人信息犯罪行为的起刑点，从而积极回应实践需求，完善敏感个人信息在刑法领域内的特殊保护体系。
In the context of big data, the protection of sensitive personal information has been widely concerned by the public, and it is difficult to meet the practical needs by relying only on the existing protection system of Personal Information Protection Law and criminal law. Due to the particularity of such information, if it is illegally violated, it will naturally lead to more serious damage to the information subject in various aspects, and it is urgent to give special protection to such sensitive personal information by criminal law regulations, and help to reasonably link up the Personal Information Protection Law and other provisions. Therefore, by clarifying the concept of sensitive personal information, canceling the classification of sensitive personal information and raising the starting point of criminal acts violating sensitive personal information, we can actively respond to practical needs and improve the special protection system of sensitive personal information in the field of criminal law.
