论居住权制度的法律价值及其完善研究

Abstract:
回溯居住权制度发展历程,创设居住权的国家或地区的队伍不断壮大。为了回应当前的社会需求,我国《民法典》也增设了居住权制度,具有划时代的意义。基于居住权制度特有的性质,分析其具有的独特理论与实践价值。但现有的居住权法律规范在设立方式、居住权主体、客体以及居住权人权利与义务等方面仍存在不足。因此,结合国外相关法律规范和我国的现实需要,我们可以针对上述居住权制度的不足提出相应的建议。对于居住权制度的完善路径主要从完善居住权制度设立方式及规则、明晰居住权制度的主体与客体以及细化居住权人权利与义务三个方面来展开。
Looking back on the development of the right of abode system, the number of countries or regions that have created the right of abode has continued to grow. In response to the current social needs, China’s Civil Code has also added the right of abode system, which is of epoch-making significance. Based on the unique nature of the right of abode system, analyze its unique theoretical and practical value. However, the existing legal norms of the right of abode are still deficient in the establishment method, the subject and object of the right of abode, and the rights and obligations of the right of abode holders. Therefore, combining the relevant legal norms of foreign countries and the practical needs of China, we can put forward corresponding suggestions for the inadequacy of the right of abode system. The improvement of the right of abode system is mainly based on the three aspects of improving the establishment and rules of the right of abode system, clarifying the subjects and objects of the right of abode system, and refining the rights and obligations of the right of abode holders.
