论行政诉权滥用的法律规制

在行政诉讼中，随着立案登记制取代立案审查制，保障了公民权利的同时也逐渐出现了滥用诉权的现象，该现象不仅浪费了司法资源，严重影响了审判人员的工作效率，还败坏了社会的风气，使人们对司法公正产生怀疑。规制滥用行政诉权的问题，应该在准确界定滥用行政诉权的概念和把握滥用行政诉权行为形成原因的基础上，通过完善立案登记制和政府信息公开制度，并健全配套监督复查制度来达成。
In administrative litigation, as the case registration system replaces the case investigation system, the phenomenon of abuse of the right of action gradually appears while protecting the rights of citizens. This phenomenon not only wastes the judicial resources, seriously affects the efficiency of the judges, but also corrupts the social atmosphere and makes people doubt the judicial justice. On the basis of accurately defining the concept of the abuse of administrative litigation right and grasping the causes of the behavior of the abuse of administrative litigation right, the regulation should be achieved through perfecting the registration system of case filing and the system of government information disclosure, and perfecting the supporting supervision and review system.
