Abstract:

本研究深入探讨了物权法框架下不动产登记制度的效力及其在实践中遇到的问题。通过对不动产登记的法律基础、确权与公示功能的分析,揭示了该制度在促进交易安全、提高市场透明度方面的核心作用。然而,实践中存在的挑战,如登记程序的复杂性、信息准确性及更新滞后问题,以及法律与实践的脱节等,严重影响了制度的有效性。为应对这些问题,研究采取了比较法研究方法,借鉴国际经验,提出了简化登记程序、加强电子登记系统应用、提高法律法规适应性以及加强人员培训和法律责任明确等解决方案。最终,研究指出通过这些改革措施,可以有效提升不动产登记制度的效率和准确性,促进不动产市场的健康发展,并更好地保障人民财产权益,为物权法框架下的不动产登记制度的持续优化和发展提供了有力支撑。
This study deeply discusses the effectiveness of the real estate registration system under the framework of property law and the problems encountered in practice. Through the analysis of the legal basis, right confirmation and publicity functions of real estate registration, this paper reveals the core role of the system in promoting transaction security and enhancing market transparency. However, challenges in practice, such as the complexity of registration procedures, the lag in information accuracy and update, and the disconnect between law and practice, have seriously affected the effectiveness of the system. In order to deal with these problems, the research adopts the comparative method, draws on international experience, and puts forward some solutions such as simplifying registration procedures, strengthening the application of electronic registration system, improving the adaptability of laws and regulations, strengthening personnel training and clarifying legal responsibilities. Finally, the study points out that these reform measures can effectively improve the efficiency and accuracy of the real estate registration system, promote the healthy development of the real estate market, and better protect people’s property rights and interests, providing a strong support for the continuous optimization and development of the real estate registration system under the framework of the property law.
