新时代警检关系模式的问题检视与优化思路

警检关系作为刑事诉讼关系的重要组成部分，对惩罚犯罪与保障人权具有深远意义。我国法制正稳步健全，但警检关系发展过程中仍存在公安机关侦查方式欠妥、检察机关监督乏力、警检配合不充分等问题，不利于保持良好的刑事司法秩序。进入新时代，在以审判为中心的诉讼制度改革推动下，我国应立足本土实际，通过确立检察引导侦查模式、形成“大控方”追诉格局等方式优化目前的警检关系，努力实现刑事诉讼的价值与目标，确保刑事诉讼程序顺利进行。
As an important part of the criminal procedure relationship, the relationship between police and procuratorate is of far-reaching significance to the punishment of crimes and the protection of human rights. China’s legal system is steadily improving, but there are still problems such as improper investigation methods of public security organs, weak supervision of procuratorial organs, insufficient cooperation between police and procuratorate, which is not conducive to maintaining a good criminal judicial order and enhancing judicial credibility. In the new era, driven by the reform of the trial-centered litigation system, China should base on the local reality, optimize the current relationship between police and procuratorate mode by establishing the procurator- guided investigation mode and forming the pattern of “big prosecution” pattern, so as to ensure that the value and goal of criminal litigation are realized in an unbiased manner.
