《家庭教育促进法》背景下新时代家庭教育的实践困境及解决方案的探究

Abstract:

《中华人民共和国家庭教育促进法》(下称《家庭教育促进法》)具有引导全社会注重家教家风的建设的立法目的,体现着培养德、智、体、美、劳五育并进,全面发展的社会主义建设者和接班人的立法宗旨。这部法律对家庭教育实施过程中多个主体之间的权利义务关系进行了规制。比如父母或其他监护人与未成年人之间的家庭教育实施与接受关系;学校、政府和社会各组织组织与父母或其他监护人之间的家庭教育保障与服务关系;公安司法机关与父母或其他监护人之间构成的家庭教育保护与救济关系等。家庭教育实施过程中如此多样的权利义务关系难免产生多种困境。本文对《家庭教育促进法》规制下家庭教育实施过程中所可能面临的困境进行分析,并提出了可行的解决方案。
The “Family Education Promotion Law of the People’s Republic of China” (hereinafter referred to as the “Family Education Promotion Law”) has the legislative purpose of guiding the whole society to pay attention to the construction of family education and family ethics, reflecting the legislative purpose of cultivating socialist builders and successors who are well-rounded and develop in morality, intelligence, physical fitness, aesthetics, and labor. This law regulates the rights and obligations between multiple subjects in the implementation process of family education. For example, the implementation and acceptance of family education between parents or other guardians and minors; the family education security and service relationship between schools, governments, and various social organizations and parents or other guardians; the family education protection and relief relationship formed between the public security and judicial organs and parents or other guardians. The diverse rights and obligations in the implementation of family education inevitably lead to various difficulties. This article analyzes the difficulties that may arise during the implementation of family education under the regulation of the Family Education Promotion Law, and proposes feasible solutions.
