“双碳”目标下我国气候变化诉讼制度的探索路径
The Exploration Path of China’s Climate Change Litigation System under the Goal of “Carbon Peaking and Carbon Neutrality”

气候变化是当前人类应对环境问题的巨大挑战，究其背后的根源为人类过度排放二氧化碳等温室气体。我国正处于“双碳”目标实现的关键时期，气候变化诉讼作为实现“双碳”治理不可或缺的司法参与路径，同样也面临着一系列问题和挑战。气候变化诉讼请求权基础缺失、起诉主体受限、因果关系难以确立等问题使得我国在参与全球气候治理面临实际的阻碍。为进一步促进“双碳”目标的实现，应借鉴国际气候变化诉讼的探索经验，构建符合中国国情的气候变化诉讼制度。
Climate change is a great challenge for human beings to deal with environmental problems, and the root cause behind it is the excessive emission of greenhouse gases such as carbon dioxide. China is in a critical period to achieve the goal of “Carbon Peaking and Carbon Neutrality”. As an indispensable judicial participation path of “Carbon Peaking and Carbon Neutrality” governance, climate change litigation is also facing a series of problems and challenges. Because of the lack of the basis of climate change litigation claim, the limitation of the subject of prosecution and the difficulty of causality, China is faced with real obstacles in participating in global climate governance. In order to further promote the realization of the goal of “Carbon Peaking and Carbon Neutrality”, we should learn from the exploration experience of international climate change litigation and build a climate change litigation system in line with China’s national conditions.
