自贸试验区临时仲裁制度的构建具有必要性，本文通过分析临时仲裁制度在我国法域视角下的发展脉络，厘清自贸区临时仲裁实践中我国《仲裁法》对临时仲裁的合法性尚未认可、无法满足临时仲裁的灵活性与效率性要求、仲裁员的选择有待明晰、仲裁机构与临时仲裁的关系未予以明确等存在的一系列障碍，不断探索建立和实践临时仲裁制度，并在实践中进一步完善，通过赋予涉外领域临时仲裁以合法性地位、制定理念先进且普遍适用于各自贸试验区的临时仲裁规则、对仲裁员的选择放宽限制条件、仲裁机构辅助临时仲裁，实现临时仲裁制度在我国全面推行与落实。
By analyzing the development of the Interim arbitration system from the perspective of China’s jurisdiction, this paper clarifies that the legitimacy of Interim arbitration in the Arbitration Law of China has not yet been recognized, the flexibility and efficiency requirements of Interim arbitration cannot be met, and the selection of arbitrators needs to be clarified. The relationship between arbitration institutions and Interim arbitration has not been clarified, and a series of obstacles exist, and the establishment and practice of the Interim arbitration system have been continuously explored and practiced, and further improved in practice, by giving legitimacy to Interim arbitration in foreign-related fields, formulating Interim arbitration rules with advanced concepts and generally applicable to their respective pilot trade zones, relaxing restrictions on the selection of arbitrators, and assisting Interim arbitration by arbitration institutions, so as to realize the full implementation and implementation of the Interim arbitration system in China.
