老龄化加速背景下强化农村地区养老法律保障的困境及对策

Abstract:
近年来,伴随着人口老龄化的加速,我国农村地区居民的养老法律保障问题作为民生问题越来越受到国家政策层面的关注,强化农村地区居民的养老法律保障也已然被视为是实现共同富裕的应有之义、构建法治社会的内在要求以及维护广大农民根本利益的必然举措。然而,当前我国还面临着缺乏针对农村地区的独立养老保障法律法规,农村地区养老保障方面的相关法律法规不完善以及农村地区老年人与赡养人相关法律意识淡薄等困境。基于现实考量,老龄化加速背景下强化农村地区养老法律保障可以从三方面入手:一是提高立法层级,制定农村养老保障的专门单行法;二是细化法律条文,明确不履行赡养义务的法律责任;三是增加财政投入,加大养老保障的法制宣传力度。
In recent years, with the acceleration of population aging, the legal security of old-age pension for rural residents in China has been paid more and more attention by the national policy level as a livelihood issue. Strengthening the legal security of old-age pension for rural residents has been regarded as an inevitable measure to achieve common prosperity, build a rule of law society and safeguard the fundamental interests of farmers. However, at present, China is still facing the dilemma of lack of independent laws and regulations for rural areas, imperfect laws and regulations in rural old-age pension and weak legal awareness of the elderly and their dependents in rural areas. Based on realistic considerations, under the background of accelerated aging, the legal security of old-age pension in rural areas can be strengthened from three aspects: first, improve the legislative level and formulate a special law for rural old-age pension; second, refine the legal provisions and clarify the legal responsibility for not fulfilling the obligation of supporting; third, increase financial input and strengthen the legal publicity of old-age pension.
