碳排放权交易立法困境及解决路径研究
Research on the Legislative Dilemma and Solution of Carbon Emission Rights Trading

自我国提出“双碳”战略，即于2030年实现碳达峰、2060年实现碳中和后，为实施这一宏伟计划，亟需法治保驾护航。碳排放权交易法治化是关键一环。自从2011年启动碳排放交易工作以来，虽然在行政体制建设、法律法规顶层设计等方面进行了一系列探索，但目前仍然存在缺乏高位阶上位法、碳排放权法律属性不明、监管主体难以满足碳交易金融化发展方向等显著问题，文章通过对碳排放权交易立法相关现状进行梳理，概述碳排放权交易法律制度，分析立法和市场交易实践中暴露出的典型问题，尝试探索提出针对性的完善建议。
Since China put forward the “double carbon” strategy, that is, to achieve carbon peak in 2030 and carbon neutrality in 2060, it is urgent to escort the rule of law for the implementation of this grand plan. Legalization of carbon emission trading is a key step. Since China started carbon trading work in 2011, although a series of explorations have been made in the aspects of administrative system construction and top-level design of laws and regulations, there are still significant problems such as lack of high-level law, unclear legal attribute of carbon emission rights, and difficulty for regulatory bodies to meet the development direction of carbon trading financialization. By sorting out the current situation of carbon emission trading legislation, this paper outlines the legal system of carbon emission trading, analyzes typical problems exposed in legislation and market trading practices, and tries to explore and put forward targeted suggestions for improvement.
