论网络暴力犯罪刑法规制的完善
On the Improvement of the Criminal Law System for Cyber Violence Crimes

近年来，我国的互联网产业高速发展，互联网的发展给我们的生活带来诸多便利的同时，也带来了很多负面影响。互联网的匿名性使得一些网络用户更容易跨过道德底线，发表攻击性和侮辱性的言论。网络暴力事件时常发生，网络暴力犯罪成为了一个不容忽视的问题。但是，现行刑法并不完善，因此，完善网络暴力犯罪的刑法规制显得尤为重要。本文旨在探讨网络暴力犯罪的特点，分析现行法律对网络暴力犯罪的规制存在的入罪的界定标准模糊，刑事责任划分困难等问题，提出了明确网络暴力行为入罪的认定标准和责任划分标准，网络暴力犯罪入刑等完善建议。
In recent years, China’s Internet industry has been developing at a high speed, and while the development of the Internet has brought a lot of convenience to our lives, it has also brought a lot of negative impacts. The anonymity of the Internet makes it easier for some Internet users to cross the moral line and make offensive and insulting remarks. Internet violence occurs from time to time, and Internet violence crime has become a problem that cannot be ignored. However, the current criminal law is not perfect, so it is especially important to improve the criminal law system of cyber violence crime. The purpose of this paper is to discuss the characteristics of cyber violence crime, analyze the problems that the existing law on the regulation of cyber violence crime has a vague definition of incriminating and it is difficult to delineate the criminal responsibility, put forward a clear identification standards and responsibility division standards for cyber violence incriminating, and cyber violence crime should be in the criminal law and other recommendations.
