浅谈政府线上发放消费券之法律问题

Abstract:

随着互联网平台经济的发展,政府多通过平台采取线上模式发放消费券。与消费券的传统发放模式相比,线上发放消费券增加了平台这一主体,由此产生了一些问题,如政府片面选择大型平台投放消费券;平台方不公平选择消费券投放商家;消费券发放方式不合理。针对上述问题,应采取相应措施予以解决。于政府,应当引入公平竞争审查机制保证平台选择的正当性;于平台,应当保证其设定规则透明化,同时加强政府对平台选择消费券投放商家的监督;此外,应当改善“发券”模式,宜采取线上与线下相结合的“发券”模式,同时应当针对不同目的的消费券采取不同的“发券”方式。
With the development of the Internet platform economy, the government mostly adopts the online mode to issue consumption coupons through the platform. Compared with the traditional issuance mode of consumption coupons, online issuance of consumption coupons increases the main body of the platform, resulting in new problems, such as the government unilaterally choosing large platforms to issue consumer vouchers; the platform unfairly selects the merchants who issue the coupons; the way of issuing consumption coupons is unreasonable. In view of the above problems, appropriate measures should be taken to solve them. For the government, the fair competition review mechanism should be introduced to ensure the legitimacy of platform selection. As for the platform, it should ensure the transparency of its setting rules, and strengthen the government’s supervision over the platform’s selection of consumption coupons. In addition, the “coupons” model should be improved, and a combination of online and offline “coupons” model should be adopted, and different “coupons” methods should be adopted for different purposes of consumption coupons.
