算法推送下消费者权益法律保护问题研究
Research on the Legal Protection of Consumer Rights and Interests under Algorithmic Push

随着算法技术嵌入应用于各种场景之中，大数据杀熟、信息茧房等弊端也逐渐显露。虽然算法技术是中立的，但在平台运用时引发了算法推送与消费者知情权、公平交易权等权利间的冲突。为此，本文通过剖析算法与平台之间的关系进而拨开“算法遮蔽”，以明确责任划分。最后，面对我国算法推送下消费者权益保护的困境，通过域外即欧美等发达国家已有的救济途径分析，从政策、平台和个人角度多层次提出自上而下的完善要求。
With the embedding of algorithm technology in various scenarios, the drawbacks of big data killing and information cocooning are gradually revealed. Although the algorithm technology is neutral, the application of the platform has caused a conflict between the algorithm push and the consumer’s right to know and the right to fair trade. To this end, this paper analyzes the relationship between algorithms and platforms and then removes the “algorithm masking” to clarify the division of responsibilities. Finally, in the face of the dilemma of consumer rights protection under the push of algorithms in China, through the analysis of the existing remedies in developed countries such as Europe and the United States, the top-down improvement requirements are put forward from the perspectives of policies, platforms and individuals.
