司改背景下检察官职业伦理变迁及展望
Changes and Prospects of Prosecutors’ Professional Ethics in the Context of Judicial Reforms

检察官职业伦理是检察权行使的重要保障，是建立司法公信的基础，更是实现检察工作现代化的价值基础。从20世纪80年代第一轮司法改革伊始，后续五轮司法改革均对检察官职业伦理提出了更高标准的要求，检察官职业伦理的表现直接影响着检察机关的公众形象。我国目前检察官的职业素能有待进一步提升，为实现这一目标，通过总结我国司法改革丰富实践，研究实现检察工作现代化对检察官职业伦理的要求与挑战，重点关注检察官职业伦理的具体表现，包括其职责、权利、义务等方面，通过制度建设，优化伦理规范、尊重现实人性，强化底线伦理、发挥示范作用，形成伦理引导几方面对我国检察官职业伦理建设提供有益建议。
Prosecutors’ professional ethics is an important guarantee for the exercise of prosecutorial power, the basis for the establishment of judicial credibility, and the value foundation for the modernization of prosecutorial work. From the beginning of the first round of judicial reform in the 1980s, the subsequent five rounds of judicial reform have put forward higher standard requirements for prosecutors’ professional ethics, and the performance of prosecutors’ professional ethics has a direct impact on the public image of the prosecution. At present, the professional qualities of prosecutors in China need to be further improved. In order to achieve this goal, by summarizing the rich practice of judicial reform in China, studying the requirements and challenges of modernizing the prosecutorial work on the professional ethics of prosecutors, focusing on the specific performance of the professional ethics of prosecutors, including their duties, rights, obligations, etc., so as to provide useful suggestions for the construction of the professional ethics of prosecutors in China from the aspects of system construction, optimization of ethical norms, respect for realistic human nature, strengthening the bottom line ethics, playing an exemplary role, and forming ethical guidance.
