帮助信息网络犯罪活动罪的理论定位与司法实践
Theoretical Orientation and Judicial Practice of the Crime of Helping Information Network Crime

帮助信息网络犯罪活动罪是指自然人或者单位明知他人利用信息网络实施犯罪，为其犯罪提供互联网接入、服务器托管、网络存储、通讯传输等技术支持，或者提供广告推广、支付结算等帮助，情节严重的行为。自2015年写入刑法以来，该行为的理论定位和司法实践就受到高度的关注。笔者拟首先对帮信罪的理论基础和构成要件进行分析，着重分析其与中立帮助行为的关系以及其帮助行为正犯化的体系定位；接着探析该罪入刑后的司法适用情况，考察实践中出现的口袋罪和司法扩张的倾向，从主观明知的界定和客观要素的重申两个方面，对帮信罪的限缩提供自己的思路和意见。
The Crime of helping information network crime refers to the fact that natural persons or units know that others use information network to commit crimes, to provide Internet access, server hosting, network storage, communication and other technical support for their crimes, or to provide advertising, payment and settlement assistance, such as serious behavior. Since it was written into the criminal law in 2015, the theoretical orientation and judicial practice of this Act have been highly concerned. The author will first analyze the theoretical basis and elements of the crime of helping and letter, focusing on its relationship with neutral helping behavior and the system orientation of helping behavior Then it analyzes the judicial application of this crime after being sentenced, inspects the pocket crime and the tendency of judicial expansion in practice, from the two aspects of the definition of subjective knowledge and the reaffirmation of objective elements, the limitation of the crime of helping letters provides their own ideas and suggestions.
