Abstract:

隐性加班是随着信息化时代的发展以及便捷办公设备的普及而产生的。劳动者在劳动合同约定工时外仍需保持随时在线的状态,对于用人单位的工作指令要及时回复和处理,长时间“劳而不休”,其休息权、健康权以及报酬权均得不到有效保障。因此,对隐性加班的法律规制,应当以保障劳动者休息权为核心,在平衡劳资双方利益的前提下引入离线权制度、强化工时认定标准并完善对用人单位的处罚规则,最终实现对劳动者合法权益的有效保障,促进其工作和生活之间的平衡。
Implicit overtime is produced with the development of the information age and the popularization of convenient office equipment. Workers must remain online at all times outside of the working hours stipulated in the labor contract, respond to and handle the employer’s work instructions in a timely manner, and work without rest for long periods of time. Workers’ right of rest, health right and remuneration right cannot be effectively guaranteed. Therefore, the legal regulation of implicit overtime should guarantee workers rest right as the core, in balancing both interests under the premise of introducing offline right system, strong chemical standards and improve the punishment rules of unit of choose and employ persons, finally realize the effective protection of the legitimate rights and interests of workers, promote the balance between the work and life.
