侵犯公民个人信息罪在具体实践中，“情节严重”与“情节特别严重”的具体指标适用存在模糊。“按相应比例合计达到有关数量标准”个案适用较少，原因或是其他几项规定能满足大部分案件，因此不需要适用该项规定；或是该项规定难以在具体案件中适用，且可能不利于被告，因此不选择适用该项规定。侵犯公民个人信息罪在具体个案中一般不认为构成共犯，原因一是实务中较难证明行为人对他人犯罪之主观心态是“知道或者应当知道”；二是我国现行刑法框架下还需另外证明行为人对于他人利用信息所实施犯罪之犯罪结果之主观方面须为故意或间接故意。
In the concrete practice, the specific indicators of “serious circumstances” and “particularly serious circumstances” are ambiguous. There are fewer cases in which “the relevant quantity standard is achieved in a proportionate aggregate”, because several other requirements satisfy the majority of cases, so there is no need to apply this requirement; or the provision is difficult to be applied in a specific case and may be detrimental to the defendant, and therefore it is not chosen to apply. Generally, the crime of infringing citizens’ personal information is not considered to be an accomplice in specific cases. First, it is difficult to prove that the perpetrator’s subjective attitude towards others is “know or should know”. Second, under the framework of our current criminal law, it is also necessary to prove that the subjective aspect of the criminal result of the crime committed by others using information must be intentional or indirect intentional.
