浅析犯罪未遂与犯罪中止的认定区分标准
A Brief Analysis of the Identification and Distinction Standards of Attempted Crime and Discontinuation of Crime

故意犯罪形态可以分为犯罪预备、犯罪未遂、犯罪中止与犯罪既遂。相对于既遂犯，我们将犯罪预备、犯罪未遂，犯罪中止称为犯罪未完成形态。其中犯罪未遂与犯罪中止天然存在着紧密联系，实务中，人们对犯罪中止与犯罪未遂的界定也有着不同的认知区分标准。本文从犯罪未遂与犯罪中止的理论出发，结合刑法的基本原则和实践，指出区分犯罪未遂与犯罪中止的意义，通过分析各种学说，最终得出犯罪未遂与犯罪中止的区分标准。
The forms of intentional crime can be divided into preparation, attempted crime, cessation of crime and completion of crime. Compared with accomplished crime, we call the preparation of crime, the attempted crime and the cessation of crime as the unfinished form of crime. There is a close relationship between the attempted crime and the discontinuance of crime. In practice, people have different cognitive standards for the definition of the discontinuance of crime and the discontinuance of crime. Based on the theory of attempted crime and discontinuance of crime and the basic principles and practice of criminal law, this paper points out the significance of distinguishing between attempted crime and discontinuance of crime, and finally obtains the standard of distinguishing between attempted crime and discontinuance of crime by analyzing various theories.
