我国网络虚拟财产法律保护现状及完善建议

在科技和网络飞速发展的当今社会，虚拟财产这一概念日渐融入到我们的日常生活中，成为当下热门的话题，同样虚拟财产也在某种程度上影响着我们的思想和行为。然而，随着网络技术的发达程度不断提高，立法和司法层面的不全面不完善，虚拟财产所引发的纠纷也不在少数。网络虚拟财产的保护不仅要挖掘其发展现状背后的原因，还需要进一步探究虚拟财产相关法律体系建立的困难之处。《民法典》第一百二十七条规定，法律对数据、网络虚拟财产的保护有规定的，依照其规定。该规定将虚拟财产保护的问题做出明确法律依据，对网络虚拟财产的法律地位作出了回应，以期在立法和司法两方面寻求保护路径。
With the rapid development of technology and the Internet, the concept of virtual property is becoming a hot topic in our daily life, also, virtual property affects our thoughts and behaviors to some extent. However, with the development of network technology, legislation and judicial level are not perfect, virtual property is caused by the number of disputes. The protection of network virtual property not only needs to explore the reasons behind its development, but also needs to further explore the difficulties of the establishment of a virtual property-related legal system. Article One Hundred and Twenty-seven of the Civil Code stipulates that where the law provides for the protection of data and network virtual property, such provisions shall apply. This regulation makes clear the legal basis of the protection of virtual property, and responds to the legal status of virtual property in order to seek the way of protection in legislation and judicature.
