远程办公新劳动形式法律规制研究

Abstract:
近几年疫情的催化加之互联网的发展使远程办公逐渐兴起,虽然远程办公具有传统劳动方式无法比拟的优势,但还是不可避免的带来了许多问题,目前我国仍缺乏关于新型劳动方式及其劳动者权益保障的相关法律法规。本文以远程办公为切入点,在介绍远程办公相关概念之后,重点关注了远程办公劳动者的劳动权益,总结了目前我国关于远程办公劳动者劳动权益保障的现状及其遭遇的困境,并对造成困境的原因进行了分析。通过对远程办公和远程办公中劳动者的劳动权益进行分析,对于如何保障我国远程办公劳动者的劳动权益问题进行了探讨,在合理吸收借鉴域外对于远程办公劳动者劳动权益的保护经验的前提下,从我国实际出发,提出了相关的建议,以期能够构建远程办公中和谐稳定的劳动关系。
In recent years, the catalysis of the epidemic situation and the development of the Internet have made telecommuting on the rise. Although remote office has an incomparable advantage over traditional labor methods, it is still inevitable to bring many problems. At present, there is still a lack of relevant laws and regulations on the new mode of labor and the protection of workers’ rights and interests in China. Starting from telecommuting, after introducing the related concepts of telecommuting, this paper focuses on the labor rights and interests of telecommuting workers, summarizes the current status of the protection of telecommuting workers’ labor rights and interests in China and the difficulties encountered, and analyzes the causes of the difficulties. Based on the analysis of telecommuting and telecommuting workers’ labor rights and interests, this paper discusses how to protect the labor rights and interests of telecommuting workers in China. Based on the premise of reasonably drawing on foreign experience in the protection of telecommuting workers’ labor rights and interests, this paper puts forward some relevant suggestions in order to achieve a harmonious and stable labor relationship in remote work.
