Abstract:

随着市场经济的不断发展,公民对社会主义文化和科学事业领域的追求也不断提高,由于大量的作品名称被用于商业领域而引发的侵权纠纷纷涌而至,但是目前我国在著作权法并没有对该类客体保护作出具体的规定,对于其是否能够属于著作权法意义上的客体具有争议,同时理论界与实务界对其权益认定和保护路径意见不一。有学者将其纳入商品化权益有一定的不适性,笔者通过借鉴德国和美国相关的理论,建议应当其纳入商业标志领域,直接适用《商标法》或《反不正当竞争法》。
With the continuous development of the market economy, citizens’ pursuit of socialist culture and scientific undertakings is also increasing. Due to the large number of works’ titles being used in the commercial field, infringement is being rectified one after another. However, at present, China's copyright law has not made specific provisions on the protection of such objects, and it is controversial whether they can belong to the object in the sense of copyright law. At the same time, the theoretical circle and the practical circle have different opinions on the identification and protection path of their rights and interests. Some scholars have some inappropriability to include it in the commercialization rights. The author, by drawing on the relevant theories of Germany and the United States, suggests that it should be included in the field of commercial marks and directly apply the Trademark Law or the Anti-Unfair Competition Law.
