国际法渊源问题研究
Study on the Sources of International Law

国际法是与国内法相对比来讲的，是一套被国际社会普遍承认的规则和原则，用于约束和管理国与国之间的关系。国际法的渊源至少含有“源流”、“过程”和“形式”等因素，虽然《国际法院规约》第38条第1款有对国际法形式渊源的权威说明，但是条约并未规定其定义，在国际法渊源中国际法形式渊源起着重要作用。纵观学术界，国际法权威学者们对国际法渊源的概念的论述和国际法渊源的外延，几乎保持一样的观点；然而在对国际法渊源的定义却迥然各异。本文将从国际法的渊源的定义、国际法渊源的分类及国际法的形式渊源的相关问题进行论述。
International law is a collective term for norms that regulate the rights and obligations of all member States, in contrast to domestic law. The sources of international law contain at least elements such as “source”, “process” and “form”, Although Article 38, paragraph 1, of the Statute of the International Court of Justice, contains an authoritative description of the formal sources of international law, the treaty does not provide for its definition. The formal source of international law plays the most important role in the source of international law. This article will discuss the definition of sources of international law, the classification of sources of international law and issues related to the formal sources of international law.
